1. Introduction

These Terms and Conditions ("Terms") govern your use of Marketer Digest ("the Service"), operated by Beezypro Ltd ("we", "us", "our"). The Service is accessible at marketerdigest.com and app.marketerdigest.com.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Marketer Digest is a SaaS platform that helps you manage newsletter subscriptions. The Service provides you with a unique intake email address to which you forward your newsletters. The Service then uses AI to summarize those newsletters and delivers a consolidated daily digest to your email.

3. Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement.

4. Account Registration and Security

To use the Service, you must create an account using a valid email address or a supported social login provider (Google or GitHub).

You are responsible for:

  • Providing accurate and complete registration information
  • Maintaining the security and confidentiality of your account credentials
  • All activity that occurs under your account

You must notify us immediately at support@marketerdigest.com if you suspect unauthorized access to your account.

5. Acceptable Use

You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You must not:

  • Use the Service to process, store, or distribute illegal, harmful, or offensive content
  • Forward spam, phishing emails, or malicious content to your intake address
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service, its servers, or networks
  • Use automated tools (bots, scrapers) to access the Service beyond its intended functionality
  • Share your account credentials with others or allow multiple individuals to use a single account
  • Resell, redistribute, or commercially exploit the Service without our written consent
  • Use the Service in a way that places an unreasonable or disproportionate load on our infrastructure

6. Plans and Pricing

The Service offers subscription plans, which may include free tiers, trial periods, and paid plans. Details of available plans, features, and pricing are displayed on our website and may change from time to time.

We will notify existing subscribers at least 30 days in advance of any pricing changes that affect their current plan.

If your plan includes a trial period, you will have full access to the Service during the trial. At the end of the trial, your access to paid features will be suspended unless you subscribe to a paid plan.

7. Payments and Billing

Paid subscriptions are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). Payment is processed by our third-party payment provider (currently Stripe).

By subscribing to a paid plan, you authorize us to charge your chosen payment method on each billing cycle until you cancel.

8. Cancellation and Refunds

You may cancel your paid subscription at any time from your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period
  • You will not be charged for subsequent billing periods
  • No refunds are provided for partial billing periods

If you believe you have been charged in error, contact us at support@marketerdigest.com within 14 days of the charge.

Under EU consumer protection law, you have the right to withdraw from a purchase within 14 days. However, by subscribing and using the Service, you acknowledge that the digital service begins immediately upon subscription, and you consent to waive your right of withdrawal once the Service has been fully provided during that period.

9. Fair Use

While we do not impose strict limits on the number of newsletters you can forward, the Service is designed for personal or professional newsletter management at reasonable volumes.

We reserve the right to contact you and, if necessary, restrict or suspend your account if your usage is significantly above normal patterns and impacts the Service for other users. We will always attempt to resolve such situations through communication before taking any action.

10. AI-Generated Content

The Service uses third-party artificial intelligence providers to generate newsletter summaries. You acknowledge that:

  • AI-generated summaries are automated interpretations and may not be fully accurate or complete
  • Summaries are provided for convenience and do not replace reading the original newsletters
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content
  • You should not rely on AI summaries for critical decisions without consulting the original content

11. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Beezypro Ltd and protected by applicable intellectual property laws.

The newsletters you forward to the Service remain your content. We do not claim ownership of your newsletters or the data you provide. We process your content solely to provide the Service as described in our Privacy Policy.

12. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

13. Account Suspension and Termination

By You

You may delete your account at any time from your account settings. Upon deletion:

  • Any active paid subscription will be cancelled
  • Your account and all associated data (including newsletters, summaries, and digest history) will be permanently deleted
  • This action is irreversible

By Us

We may suspend or terminate your account:

  • Immediately, without prior notice, if you materially violate these Terms (e.g., prohibited use, abusive behavior)
  • With 30 days' notice for any other reason, including discontinuation of the Service

In case of suspension, we will notify you of the reason and, where applicable, provide an opportunity to remedy the issue.

14. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:

  • Scheduled or emergency maintenance
  • Infrastructure or third-party service issues
  • Events beyond our reasonable control

We are not liable for any losses resulting from Service unavailability.

15. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" and "as available" without warranties of any kind, express or implied
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim
  • We are not liable for any loss of data, missed newsletters, inaccurate summaries, or undelivered digests

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable law.

16. Third-Party Services

The Service integrates with third-party services (including email providers, payment processors, AI providers, and analytics services) as described in our Privacy Policy. We are not responsible for the availability, accuracy, or practices of these third-party services.

17. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page.

For material changes, we will notify you via email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

18. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Bulgaria, without regard to its conflict of laws provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved by the competent courts in Bulgaria. If you are a consumer in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Beezypro Ltd regarding your use of the Service. They supersede any prior agreements, communications, or representations, whether written or oral.
